Capezzana Commodities SA undertakes to respect the privacy of your personal data.

The purpose of this General Data Protection Policy is to describe how the personal data (hereinafter “Data”) that Capezzana Commodities SA (hereinafter “Capezzana”) collects or holds is used and to whom this Data may be disclosed.

The processing of Data by Capezzana is subject to the applicable data protection legislation in force in Switzerland, in particular the new Federal Law on Data Protection (hereinafter “nLPD”).

Capezzana undertakes to :

  • use the Data only for the purposes indicated;
  • collect only the Data it needs for these purposes;
  • not to retain Data for longer than is necessary for these purposes;
  • communicate the Data only to authorised bodies or persons who need it for the purposes of Capezzana’s activities;
  • inform you in a clear and transparent manner about Capezzana’s use of the Data and its rights.

Right to withdraw consent: where Data is processed on the basis of consent, consent may be withdrawn at any time.

Right of rectification – you have the right to ask Capezzana to rectify inaccurate Data and to complete incomplete Data.

Right to restrict processing – you may request to restrict the processing of Data, if permitted by law.

Right to erasure / deletion – you have the right to request Capezzana to erase or delete Data . unless a legal basis or the legitimate interest of Capezzana requires or permits it to retain the Data.

Right to object to processing – you have the right to object to the processing of your Data at any time.

Right to delivery or transmission of Data – you have the right to request the delivery or transmission of Data in a portable format where the processing of the Data is automated, based on consent or contract.

Right to lodge a complaint: if you are not satisfied with the way in which the Data is processed, you may lodge a complaint with the courts or with the federal data protection authority.

Capezzana may disclose the Data to its employees, subcontractors, consultants and service suppliers solely in order to fulfil its duties and provide its services and provided that the legal conditions are met.

To protect your privacy and security, Capezzana may take reasonable steps to verify their identity before granting access or making corrections.

Your Data may be processed abroad when appropriate. In that case Capezzana complies with the applicable rules and takes necessary precautions to prevent the transfer of your Data to a country that does not have adequate legal data protection.

Capezzana undertakes to ensure the permanent security of the Data.

Capezzana shall take reasonable and appropriate steps to maintain the confidentiality and integrity of the Data and to prevent unauthorized use or disclosure of the Data in accordance with the nLPD.

This Data, in particular back-ups and Data relating to assistance activities, is hosted by a subcontractor in Switzerland.

Capezzana processes Data only in a manner compatible with the purpose for which it was collected.

To the extent necessary for these purposes, Capezzana takes reasonable steps to ensure that the Data is accurate, complete, current and otherwise reliable for its intended use.

  1. HOW LONG DOES CAPEZZANA KEEP THE DATA?

Capezzana retains Data only for as long as is necessary to achieve the purposes for which it was collected and to fulfil Capezzana’s legal obligations.

To establish how long it will keep the Data, Capezzana applies the following criteria:

– for the services of Capezzana, Capezzana retains the Data for the duration of the services or the service contract;

– if cookies are placed on your computer, Capezzana only keeps the Data for the time necessary to achieve the purpose for which it was collected (for example, for one session for registration cookies or session identification cookies).

Capezzana may retain Data to fulfil Capezzana’s legal or regulatory obligations, and to enable Capezzana to exercise its rights (for example to bring an action in any court) or for statistical or historical purposes.

When Capezzana no longer needs to use or retain the Data, Capezzana will delete it from its systems and files or anonymise it so that you can no longer be identified.
